Abstract:

The present article is the fourth part of the cycle concerning the modern shape of the title registration system in common law countries. The aim of this article is to present the computerization of land registries within the title registration system as well as the development of so-called e-conveyancing practices. In the first section the Author discusses the current state of internal computerization of land registries, taking into account the digitalization of individual registers. The second - comprehensive - part of the article is devoted to the practices of so called e-conveyancing i.e. electronic transfer of property rights. In this area, the Author describes the evolution of e-conveyancing system in England and Wales which was adopted in Land Registration Act 2002 but eventually failed to succeed. The article discusses the main features of this system and the reasons of its failure. The next sections of the article concern solutions adopted in many Torrens jurisdictions, i. e. Ontario, Canada (so-called e-reg system), British Columbia, Canada (electronic filing system . EFS), New Zealand (Landonline) and Australian states, taking into account the latest PEXA system, developed in New South Wales and adopted in many other Australian states.
