Abstract:

The present article is the second part of the cycle concerning the modern shape of the title registration system in common law countries. The aim of this article is to present the basic substantive rules of the most universal land registration model i.e. title registration system which was implemented in various world areas. In the first section the Author discusses fundamental rule of title registration system, i.e. indefeasibility of title, according to which it is registration that vests legal title in the proprietor of a registered estate, generally regardless of the fact that the instrument which purported to make the disposition was for some reason void. The theoretical and practical meaning of this rule is discussed in the context of various interests and estates provided in common law system. The second part of the paper is devoted to the practical importance that registration of certain dispositions has in relations between parties of these dispositions, taking into account the most common dispositions, i.e. sale of land and mortgage. Finally, the last part of the article contains a detailed presentation of the public faith principle within the title registration system, focusing on the problem of acquisition a non domino and certain limitations of the indefeasibility principle, such as overriding interests, constructive trust and fraud.
